Welcome to One Futbol Academy (operated by Deno Group Pty Ltd). By registering for our programs,
creating an account, or participating in any of our services, you agree to be bound by these Terms
& Conditions ("Terms"). Please read them carefully.
1. Definitions
In these Terms:
- "We," "Us," "Our" refers to Deno Group Pty Ltd, trading as One Futbol Academy.
- "You," "Your," "Parent/Guardian" refers to the person registering for services or the legal guardian of a participating child.
- "Participant/child" refers to any child or individual enrolled in our programs.
- "Services" includes all training sessions, holiday programs, trials, assessments, and related activities.
- "Portal" refers to our online parent portal system for managing bookings and account information.
2. Registration & Account
2.1 Eligibility: You must be at least 18 years old to register. By registering a child, you confirm you are their parent or legal guardian with authority to enroll them in our programs.
2.2 Accurate Information: You agree to provide accurate, current, and complete information during registration and to update this information as necessary. We rely on this information for emergency contacts, medical requirements, and communications.
2.3 Account Security: You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. Notify us immediately of any unauthorized access.
2.4 One Account Per Family: Each family should maintain one parent account. Multiple children can be added to a single parent account.
3. Programs & Enrollment
3.1 Program Types: We offer various programs including term-based training, one-on-one sessions, group sessions, and holiday programs. Each program may have specific eligibility requirements, schedules, and fees.
3.2 Assessment: New participants may be required to complete a free trial or assessment session before enrollment to determine appropriate skill level placement.
3.3 Level Placement: We reserve the right to assess and place participants in appropriate skill levels. Level changes may occur based on progress, behavior, or coach recommendations.
3.4 Capacity Limits: Programs have limited capacity. Enrollment is subject to availability and is processed on a first-come, first-served basis. Waitlist options may be available for full sessions.
4. Fees & Payments
4.1 Term Fees: Term fees are due before or at the start of each term. Participants may not attend sessions until payment is received.
4.2 Holiday Program Fees: Holiday program fees are due at the time of booking. Your spot is not confirmed until payment is complete.
4.3 Payment Methods: We accept payments via credit card, debit card, and other methods as indicated in our Portal. All payments are processed securely.
4.4 Late Payments: Late payments may result in suspension of access to sessions. A late fee may apply as specified at time of enrollment.
4.5 Pro-Rated Fees: If you join mid-term, fees may be pro-rated based on remaining sessions. This is calculated at our discretion.
4.6 Price Changes: We reserve the right to change program fees. Changes will be communicated in advance and will apply to the next enrollment period.
5. Refunds & Cancellations
5.1 Term Programs:
- Refunds for term programs are provided only in exceptional circumstances at our sole discretion.
- If we cancel a session due facility issues, or other circumstances, a makeup session or credit will be provided.
- No refunds are provided for participant absence, withdrawal, or removal due to misconduct.
5.2 Holiday Programs:
- Cancellations made 7 or more days before the program start date may receive a full refund or credit.
- Cancellations made within 7 days of the start date are non-refundable unless the spot can be filled from the waitlist.
- No refunds for no-shows or partial attendance.
5.3 Program Cancellation by Us: If we cancel a program entirely, you will receive a full refund or credit for future programs at your choice.
6. Attendance & Sessions
6.1 Punctuality: Participants should arrive on time for sessions. Late arrivals may miss warm-up activities and may not be permitted to join for safety reasons.
6.2 Missed Sessions: If you miss a session, you may be eligible for a makeup session depending on your program type and availability. Makeup tokens may be issued for eligible absences. We require a minimum of 24 hours notice. 1-on-1 makeup sessions are not guaranteed due to limited availability are provided as a group session only.
6.3 Rescheduling: Rescheduling requests should be made through the Portal at least 24 hours in advance when possible. Make up sessions are not guaranteed and are subject to availability. 6.4 Session Changes: We reserve the right to modify session times, locations, or coaches due to operational requirements. We will provide reasonable notice of changes.
7. Conduct & Behavior
7.1 Code of Conduct: All participants, parents, and guardians must behave respectfully toward coaches, staff, other participants, and families. Bullying, harassment, discrimination, or abusive behavior will not be tolerated.
7.2 Following Instructions: Participants must follow coach instructions at all times for their safety and the safety of others.
7.3 Grounds for Removal: We reserve the right to suspend or remove any participant or family member who violates our code of conduct. No refund will be provided in cases of removal due to misconduct.
7.4 Parental Responsibility: Parents/guardians are responsible for their child's behavior before and after sessions and must ensure participants are collected promptly at the end of sessions.
8. Health & Safety
8.1 Medical Information: You must disclose any medical conditions, allergies, injuries, or special needs that may affect participation. Failure to disclose relevant health information may result in exclusion from activities.
8.2 Illness: Participants who are unwell should not attend sessions. If a participant becomes ill during a session, you will be contacted for immediate collection.
8.3 Injuries: While we take all reasonable precautions, sports activities carry inherent risks. Our coaches are trained in first aid. In case of injury, we will provide appropriate first aid and contact you immediately.
8.4 Insurance: We recommend participants have appropriate personal accident or health insurance. Our public liability insurance covers our coaches and facilities but may not cover all participant injuries.
9. Photography & Media
9.1 Consent: By enrolling, you consent to photographs and videos being taken during sessions for promotional, training, and social media purposes.
9.2 Opt-Out: If you do not wish your child to be photographed, you must notify us in writing. We will make reasonable efforts to exclude them from media capture.
9.3 Usage Rights: We retain all rights to photographs and videos taken by our staff. These may be used on our website, social media, promotional materials, and third-party platforms.
10. Personal Information & Privacy
10.1 Collection: We collect personal information necessary to provide our services, including names, contact details, medical information, and payment details.
10.2 Use: Your information is used for service delivery, communication, billing, and improving our programs. We do not sell personal information to third parties.
10.3 Storage: Personal data is stored securely in accordance with applicable privacy laws. Payment information is processed through secure third-party payment processors.
10.4 Your Rights: You may request access to, correction of, or deletion of your personal information by contacting us.
11. Communications
11.1 Contact: We may contact you via email, SMS, or phone regarding your account, sessions, updates, and promotional offers.
11.2 Opt-Out: You may opt out of marketing communications at any time. Essential service communications cannot be opted out of while enrolled.
12. Intellectual Property
All content on our website, Portal, and materials (including logos, training methods, and documentation) is our intellectual property and may not be reproduced without written permission.
13. Limitation of Liability
13.1 To the maximum extent permitted by law, we are not liable for any indirect, incidental, special, or consequential damages arising from participation in our programs.
13.2 Our total liability for any claim is limited to the fees paid for the specific program in question.
13.3 Nothing in these Terms excludes or limits liability that cannot be excluded by law.
14. Indemnification
You agree to indemnify and hold harmless Deno Group Pty Ltd, its directors, employees, and coaches from any claims, damages, or expenses arising from your or your child's participation in our programs, except where caused by our negligence.
15. Force Majeure
We are not liable for delays or failures in performance caused by circumstances beyond our reasonable control, including natural disasters, pandemics, government actions, or facility closures.
16. Amendments
We may amend these Terms at any time. Changes will be posted on our website and/or Portal. Continued use of our services after changes constitutes acceptance of the updated Terms.
17. Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
18. Governing Law
These Terms are governed by the laws of the Australian Capital Territory, Australia. Any disputes will be subject to the exclusive jurisdiction of the courts of the ACT.
